Tax Code 00602560401, VAT No. 00602560401 (hereinafter, “Data Controller”), in its capacity as data controller, informs you pursuant to EU Regulation no. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the following ways and for the following purposes:

1. PURPOSE OF THE PROCESSING

The Data Controller processes the identifying personal data pursuant to art. 4 GDPR (e.g., name, surname, address, phone number, email, bank and payment details, identification numbers and online identifiers) – hereinafter, “Personal Data” or simply “Data”) provided by you when concluding contracts for the Controller’s services.

2. PURPOSES OF THE PROCESSING

Your personal data are processed:

A) without your express consent pursuant to art. 6 letters b), c) GDPR, for the following purposes:

·         to conclude contracts for the Controller’s services;

·         to fulfill pre-contractual, contractual, and fiscal obligations arising from relations with you;

·         to comply with legal obligations or authority orders;

·         to exercise the rights and legitimate interests of the Controller (e.g., the right to legal defense).

B) Only with your specific and distinct consent (art. 7 GDPR), for marketing purposes:

·         to send you via email, post and/or SMS and/or telephone calls, newsletters, commercial communications and/or advertising material on products or services offered by the Controller, and to assess satisfaction with the quality of services;

·         to send you via email, post and/or SMS and/or telephone calls, commercial and/or promotional communications from third parties (e.g., business partners).

3. PROCESSING METHODS

The processing of your personal data is carried out through the operations listed in art. 4 no. 2) GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, erasure and destruction of data. Your personal data are processed both on paper and electronically and/or automatically.

The Controller will process personal data for the time necessary to fulfill the purposes mentioned above and in any case for no longer than 10 years from the end of the relationship for the purposes under art. 2 A), and no longer than 2 years from data collection for the purposes under art. 2 B).

4. DATA ACCESS

Your data may be made accessible for the purposes referred to in art. 2.A) and 2.B):

·         to employees and collaborators of the Controller, in their capacity as internal processors or as persons authorized to process data under art. 28 no.4 GDPR;

·         to third parties (e.g.: banks, professional firms, consultants) carrying out activities on behalf of the Controller, as external processors.

5. DATA COMMUNICATION

Without the need for express consent (art. 6 letters b) and c) GDPR), the Controller may communicate your data for the purposes set forth in art. 2.A) to those parties to whom such communication is mandatory by law or necessary to fulfill those purposes.

6. DATA TRANSFER

Personal data are stored on servers located in Via Samuel Morse, 47122 Forlì FC, within the European Union.

In case of data transfer to non-EU countries, the Controller guarantees that such transfer will be made in accordance with Chapter V of the GDPR.

7. NATURE OF DATA PROVISION AND CONSEQUENCES OF REFUSAL

The provision of data for the purposes referred to in art. 2.A) is mandatory. Without it, we cannot provide you with the services mentioned in art. 2.A).

The provision of data for the purposes referred to in art. 2.B) is optional. If the requested data are not provided, you will not receive newsletters, commercial communications, and advertising material regarding the Controller’s services. However, you will still be entitled to the services referred to in art. 2.A).

8. DATA SUBJECT’S RIGHTS

As a data subject, you are entitled to exercise the rights provided under art. 14 no.2 and 15 GDPR, specifically the rights to:

1.             obtain confirmation of whether or not personal data concerning you are being processed, and if so, access such personal data and the following information: processing purposes; personal data categories; recipients or categories of recipients to whom the personal data have been or will be disclosed; retention period or criteria used to determine it; any available information on data origin; the existence of automated decision-making.

2.             withdraw consent given pursuant to art. 7 no. 3) GDPR

3.             lodge a complaint with a supervisory authority under art. 14 letter e) and 77 GDPR

4.             obtain:

a.   the rectification of inaccurate personal data concerning you pursuant to art. 16 GDPR;

b.   the erasure of data pursuant to art. 17 GDPR;

c.   confirmation that the actions under letters a) and b) have been notified, including their content, to those to whom the data were disclosed, except where this proves impossible or involves disproportionate effort;

d.   restriction of processing pursuant to art. 18 GDPR;

e.   data portability pursuant to art. 20 GDPR.

5.             object, in whole or in part pursuant to art. 21 GDPR:

a.   on legitimate grounds, to the processing of personal data concerning you, even if pertinent to the purpose of collection;

b.   to the processing of personal data concerning you for the purpose of sending advertising materials, direct sales, market research, or commercial communication via automated means without operator involvement, via email and/or traditional methods by phone and/or paper mail.

Please note that the data subject’s right to object, as per point b) above, for direct marketing using automated means, also applies to traditional methods, and that the data subject may still exercise the right to object only in part. Therefore, the data subject may choose to receive only traditional communications or only automated communications or none at all.

9. HOW TO EXERCISE YOUR RIGHTS

You may at any time exercise your rights by sending:
